PT Portugal, SGPS, SA ("PTP") is the holding company for an integrated group of companies engaged in the field of electronic communications and is the national leader in all business sectors in which it is involved.

PTP is committed to protecting the privacy of its customers and users of the various websites of which the various companies within the group own and in this context, has prepared this privacy policy in order to demonstrate its commitment and respect for privacy rules and personal data protection.

Thus, when in this privacy policy PTP is referred to, we are referring to PT Portugal SGPS, SA, as well as to each of the companies comprising the Group and its subsidiaries.

Why have this Privacy Policy?

It is because we want to make our privacy rules and our treatment of personal data, which we collect and process in strict compliance with and enforcement of the Personal Data Protection Act, known to our customers.

PTP complies with best practices in the field of safety and protection of personal data and to this end has approved a demanding program, capable of safeguarding the protection of data made available to us by anyone that somehow pertains to the company.

In this context, PTP has a privacy committee and personal data protection representative responsible for the implementation and verification of this privacy policy and the definition of clear rules for personal data processing, ensuring that all who entrust us with the processing of their personal data know how the company processes the data and what rights they have in this area.

The rules set out in this privacy policy complement the provisions for protection and processing of personal data in contracts that customers celebrate with the various companies of the PTP Group, as well as the rules laid down in the Terms and Conditions governing the supply of various products and services which can be found on their respective websites.

Please read this privacy policy carefully because if you are accessing one of our websites, the availability of personal data implies the knowledge and acceptance of the terms hereof. By providing your personal data, you consent to the collection, use and disclosure of the same in accordance with the rules defined here.

What does this Privacy Policy cover?

This Privacy Policy applies only to the collection and processing of personal data carried out by the Companies of the PTP Group.

On the websites of the PTP you can find links to access other websites that are unrelated to PTP. The provision of such links is done in good faith and the PTP Group cannot be held responsible for the collection and processing of personal data carried out on these websites, nor be held liable for the accuracy, credibility and functionality of websites belonging to third parties.

Thus, the provision of links to other websites outside the PTP Group does not imply any assumption of responsibility for such websites and therefore this privacy policy is not applicable to them. The PTP Group considers it peremptory to read the privacy policies of all websites you visit.

What is personal data?

When we refer to personal data we mean any information of any kind, regardless of their platform, including sound and image, relating to an identified or identifiable individual.

It is an identifiable individual who can be identified directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, mental, economic, cultural or social status.

Who is responsible for processing the data?

The entity responsible for the collection and processing of personal data is the company of PTP Group which provides the service and in this context decides which data is collected, the method of processing the data and the purposes for which it is used.

What personal information do we collect?

PTP, as part of its activity, collects and processes personal data necessary for the provision of services and / or supply of products, addressing in that context data such as name, address, phone number and email address.

Subject to compliance with the law concerning conservation and transmission of data for the purpose of investigation, detection and prosecution of serious crime, PTP only advances to processing of traffic and location data when necessary for customer billing and payment of connections.

If there is prior consent from the customer or the user, which may be retracted at any time, PTP will process the respective data traffic and location to the extent and for the time necessary for marketing of electronic communications services or the provision of added value services.

Information about your location can also be recorded and transmitted to bodies with the legal right to receive emergency calls, for the purpose of responding to incoming calls.

When and how do we collect your data?

PTP collects its data by phone, in writing or through its websites, with customer consent. As a rule, personal data is collected when the customer subscribes to one of our products or services.

Some details are mandatory and if they are not provided or are incomplete, PTP may refuse to provide the product or service concerned and will inform the customers of the mandatory nature of data provision.

If you are not a PTP Client, your data will only be processed if it is made available to the company, including through subscribing to newsletters, in which case these privacy policy rules apply.

Personal data is processed by computer and in strict compliance with personal data protection legislation and stored in a specific database created for this purpose and under no circumstances  will the collected data be used for any purpose other than that for which consent was given by the data provider.

What are the purposes of the processing of personal data?

In general, data collection is for the management of your contract and services, the provision of services to meet customer needs and interests, information and marketing, as well as the inclusion of the customer on the list of subscribers.

You provide us with personal data for other purposes, such as for the purposes of sending complaints and suggestions, dissemination of the groups institutional information and / or campaigns to raise awareness, promotions, advertising and news about products and / or PTP services as well as to carry out market research and evaluation surveys.

At the time of data you will be given more detailed information on our use of your data.

How long do we keep your personal data?

The period of time during which the data is stored and maintained varies depending on the purpose for which the information is processed.

Indeed, there are legal requirements that require the retention of data for a minimum period of time. Thus, whenever there is no specific legal requirement, the data will be stored and kept only for the minimum period necessary for the purposes for which it was collected or further processing, or for the time period authorised by the National Data Protection Commission, after which it will be deleted.

How you can access, rectify or prevent the processing of your personal data?

Under the Personal Data Protection Act, the data subject is guaranteed the right to access, update, correct or delete their personal data upon written request addressed to the Data Protection Officer Personal.

How can I refuse contact for marketing purposes?

PTP can advertise new products or services by telephone, email, SMS, MMS or any other electronic communications service to its customers unless they refuse this when the data is collected.

If you wish not to receive these communications you may decline to allow the use of your data for marketing purposes, for sending informative communications or inclusion in lists or information services at any time by sending a written request addressed to the Personal Data Protection representative.

What can you do if you receive calls of a disturbing nature?

According to legislation, when there is a breach of privacy, caller id can be provided. Accordingly, PTP may override the withholding of caller id when customers wish to determine the call-origin of unidentified disturbing calls which breach peace or their private life, with the authorisation of the National Data Protection Commission.

If you wish to request this service you should address your request to PTP’s Personal Data Protection representative.

What are the measures adopted by PT Portugal to ensure the safety of your personal data?

PTP is committed to ensuring the safety of personal data which has been made available and has adopted and implemented strict rules in this area. Compliance with these rules is a bounden duty of all those who legally gain access to them.

Bearing in mind the concern and commitment that PTP demonstrates in its defense of privacy issues, various technical and organisational security measures have been implemented in order to protect personal data provided to us from dissemination, loss, misuse, alteration, processing or unauthorized access, and against all other unlawful forms of processing.
